Skiing and snowboarding are inherently dangerous activities that involve risks of serious injury or death. The use of DiscSkis introduces additional movement and interaction with the snow surface, which may increase the risk of falls, collisions, or loss of control.
By purchasing, using, or allowing others to use DiscSkis, you acknowledge and agree to the following terms:
1. Assumption of Risk
You acknowledge that skiing, snowboarding, and the use of DiscSkis involve inherent risks, including but not limited to:
- Slips, falls, or loss of control
- Collisions with objects, people, or terrain
- Physical strain, sprains, fractures, or other injuries
- Unpredictable environmental conditions
- Equipment failure or unforeseen circumstances that may contribute to accidents
You assume full responsibility for your own safety and the safety of others while using DiscSkis. You agree to exercise caution, remain aware of your surroundings, and take all necessary precautions to prevent injury to yourself and those around you.
2. Skill Requirement & Instruction
- DiscSkis are intended for intermediate to advanced skiers and snowboarders.
- All users should seek professional instruction before using DiscSkis for the first time. A qualified ski instructor can help you understand proper techniques, balance, and safe usage.
- Any instructional videos or demonstrations produced by DiscSkis are for general guidance only and do not constitute formal training or safety advice.
- Advanced moves, particularly jumps, aerial tricks, or high-risk maneuvers, should never be attempted without consulting a certified ski or snowboard instructor.
3. Proper Use & Safety Recommendations
To minimize risk, you should:
- Securely fasten DiscSkis to your hands using the provided straps.
- Wear protective gear, including a helmet, gloves, and wrist guards.
- Use DiscSkis only in appropriate terrain and weather conditions, meaning:
- Ski on wide, well-groomed pistes that are not excessively steep.
- Avoid icy, rough, or off-piste terrain, which increases the risk of falls and injury.
- Only use DiscSkis in clear weather with good visibility to see obstacles, other skiers, and terrain changes.
- Be mindful of other skiers and snowboarders at all times.
- Avoid erratic movements and always be aware of your surroundings.
4. Responsibility for Collisions & Injuries to Others
You are solely responsible for ensuring that your use of DiscSkis does not endanger others.
By using DiscSkis, you acknowledge that:
- You must control your speed and movements to avoid posing a risk to others.
- You assume full responsibility for any injuries or damages you cause due to reckless skiing, failure to consider your surroundings, or improper use of DiscSkis.
- DiscSkis LLC assumes no liability for accidents involving third parties caused by the user’s actions.
5. No Guarantee of Performance Improvement
- DiscSkis are designed to enhance the skiing and snowboarding experience, but they do not guarantee improved skill, balance, or performance.
- You are solely responsible for your ability to control and maneuver while using this product.
6. No Responsibility for Group Use, Lessons, or Competitions
- DiscSkis LLC does not endorse, authorize, or assume responsibility for the use of DiscSkis in lessons, competitions, or guided experiences.
- Any organized use of DiscSkis is at the discretion of the event organizer, and participants assume all associated risks.
7. No Liability for Third-Party Risks
DiscSkis LLC is not responsible for injuries, damages, or accidents arising from third-party involvement, including but not limited to:
- Improper use by other individuals
- Interactions with rental equipment
- Policies enforced by ski resorts or governing bodies
8. Acknowledgment of Health & Physical Condition
By using DiscSkis, you affirm that you are in good physical health and free from any medical conditions that could impair your ability to safely participate in skiing or snowboarding activities.
You understand that:
- Physical exertion, falls, or sudden movements may aggravate existing medical conditions.
- You assume full responsibility for any resulting injuries.
9. Release of Liability & Indemnification
To the fullest extent permitted by law, you waive, release, and discharge DiscSkis LLC, its owners, employees, affiliates, and distributors from any claims, liabilities, damages, or legal actions arising from:
- Injury, death, or property damage related to the use of DiscSkis.
- Claims made by third parties due to your use of the product.
10. Personal Injury & Death Clause
- You acknowledge that skiing and snowboarding, including the use of DiscSkis, carry the risk of serious injury or death.
- By purchasing and using this product, you voluntarily assume all associated risks and release DiscSkis LLC from any claims related to personal injury, permanent disability, or fatality.
11. Mandatory Arbitration Clause
- Any disputes, claims, or controversies arising from the purchase or use of DiscSkis shall be resolved through binding arbitration in accordance with the rules of the State of Montana.
- Both parties waive the right to a jury trial or class action lawsuit.
12. Consent to Use of Marketing & Testimonials
By submitting photos, videos, or testimonials featuring DiscSkis, you grant DiscSkis LLC a worldwide, royalty-free license to:
- Use, modify, and distribute such content for marketing, advertising, and promotional purposes.
13. Governing Law & Jurisdiction
- This agreement shall be governed by the laws of the State of Montana, USA, without regard to conflict of law principles.
- If you purchase DiscSkis outside of the United States, local laws may still apply, but this agreement remains enforceable to the fullest extent permitted.
14. Severability Clause
- If any provision of this disclaimer is found to be unenforceable in a specific jurisdiction, the remainder of the agreement shall remain in full effect.
15. Agreement to Terms
By purchasing or using DiscSkis, you acknowledge that you have read, understood, and agreed to these terms. If you do not agree, do not use DiscSkis.
